En ce qui concerne la r\u00e9glementation en mati\u00e8re de pr\u00e9vention des accidents, la Cour supr\u00eame a confirm\u00e9 que l'employeur doit v\u00e9rifier que le sujet soumis aux t\u00e2ches de surveillance respecte les dispositions de la loi et celles qui lui sont imparties. Les sections unies ont pr\u00e9cis\u00e9 que les notions d'int\u00e9r\u00eat et d'avantage pr\u00e9vues par le d\u00e9cret l\u00e9gislatif 231\/2001 pour imputer la responsabilit\u00e9 p\u00e9nale \u00e0 l'entreprise, en cas de d\u00e9lits coupables, doivent n\u00e9cessairement se r\u00e9f\u00e9rer au comportement et non au d\u00e9lit. C'est la seule interpr\u00e9tation qui r\u00e9pond \u00e0 la volont\u00e9 du l\u00e9gislateur que l'on puisse d\u00e9duire de l'inclusion des crimes d'homicide involontaire et de blessures par n\u00e9gligence comme seules infractions sous-jacentes \u00e0 la responsabilit\u00e9 de l'entit\u00e9\u00a0: il est clair qu'elles ne r\u00e9pondent pas \u00e0 l'int\u00e9r\u00eat de l'entreprise, ou ne lui procurent pas d'avantage. , m\u00eame si l'entreprise aurait pu r\u00e9aliser un profit, par exemple, en \u00e9conomisant des co\u00fbts pour se conformer \u00e0 la l\u00e9gislation de pr\u00e9vention, dont la violation a caus\u00e9 l'accident.
